RELEASE OF LIABILITY AND ASSUMPTION OF RISK
By purchasing a ticket and/or attending any event or show (“Participant”) in connection with Bosque Ranch Live located at 100 Arena Run, Weatherford, Texas 76087, Participant agrees to release the Released Parties (defined below) from any and all liability for personal injury, death, and property damage, including, but not limited to liability arising from the negligence of the Released Parties; and assumes all risk for loss, including, but not limited to, injury, death or property damage to the Participant arising out of the participation in, or attendance of, the Activity (defined herein).
“Activity” means attending or participating in any Bosque Ranch Live event located at the address above and/or using or being on for any purpose the property of Released Parties including its grounds, trails, facilities, roads, buildings, barns, amenities, parking lots, sidewalks, equipment, bathrooms, event transportation, vendor booths, sponsor booths and/or rental equipment.
In consideration of being allowed to participate in the Activity, on behalf of myself and, if applicable, as a result of my ticket purchase or admission, on behalf of a minor and/or other adult, I agree as follows:
I HEREBY AGREE TO FULLY RELEASE, WAIVE, AND DISCHARGE BOSQUE RANCH LIVE, LLC, BOSQUE RANCH HEADQUARTERS, LLC, BOSQUE RANCH PRODUCTIONS, INC., AND BOSQUE RANCH EVENTS, LLC, THEIR MEMBERS, OFFICERS, MANAGERS, DIRECTORS, PARTNERS, PRINCIPALS, SUBSIDIARIES OR OTHER AFFILIATES, OFFICERS, AGENTS, AND EMPLOYEES (“RELEASED PARTIES”) FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION OF ANY KIND OR NATURE ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE, OR INJURY, INCLUDING DEATH, THAT I OR ANY OF MY PROPERTY MAY SUSTAIN RESULTING FROM MY PARTICIPATION IN OR IN ANY WAY CONNECTED WITH MY PARTICIPATION IN SUCH ACTIVITY, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, AND COVENANT NOT TO SUE THE RELEASED PARTIES BASED ON THE SAME.
It is my express intent that this Release of Liability and Assumption of Risk (“Release”) bind my family members, spouse, heirs, assigns, personal representatives, and anyone else entitled to act on my behalf to the extent they act on my behalf, and is deemed as a release, waiver, discharge, and covenant not to sue the Released Parties.
I am aware that horses (equine) may be present in or around any Activity. I am aware of the propensity of an equine to behave in ways that may result in injury, harm, or death to persons on or around them. In addition, I am further aware of the unpredictability of the equine’s reaction to such things as sound, sudden movement, and unfamiliar objects, persons or animals. Knowing all of the above, it is my intention to enter into this agreement with full knowledge of the risks and dangers associated with being around equine activity.
I FURTHER COVENANT AND AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY LOSS, LIABILITY, DAMAGE, OR COSTS, INCLUDING ATTORNEYS; FEES AND COURT COSTS, THEY MAY INCUR ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE, INCLUDING AS A RESULT OF NEGLIGENT RESCUE OPERATIONS.
I hereby consent to receive any medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activity. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. I hereby release, forever discharge, and hold harmless the Released Parties from any claim based on such treatment or other medical services.
I further hereby grant to Bosque Ranch Events, LLC, along with its employees, agents, licensees, successors, assigns, and those acting with its express permission or authority (collectively, “Licensed Parties”), an irrevocable and unrestricted right and permission to record, by means of taping, photographing, or otherwise, my appearance, name, image, likeness, voice, and performance arising, relating to, or resulting from my activities at the Activity, in any and all manners, formats, or contexts whatsoever, for the purpose of creating promotional content and materials (collectively, “Materials”) for use by Bosque Ranch Events, LLC.
The Licensed Parties shall have the exclusive right to copy, reproduce, adapt, edit, summarize, copyright, publish, exhibit, distribute, perform, and otherwise exploit the Materials on their marketing and social media platforms, owned and operated websites, and in all types of advertising and promotion of the foregoing, for a period of ninety-nine (99) years from the date hereof. I hereby expressly and irrecoverably waive and release rights in connection with such use, including any claim to compensation, invasion of privacy, right of publicity, or to misappropriation.
I further covenant and agree that this Release shall be construed in accordance with the laws of the State of Texas and that any mediation, suit, or other proceeding relating to this Release and any activities covered hereby must be filed or entered into only in Tarrant County, Texas. Any portion of this Release deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the Release as a whole to the full extent authorized by law.
By accepting this Agreement and purchasing a ticket on behalf of any Participants other than myself, I am representing under penalty of fraud that I am entitled to execute this Agreement as either the parent or legal guardian of the Participant or that I have been given the express authority and permission from the other adult Participants to accept the terms of this Agreement on each of their behalf, and that by doing so, I am agreeing to be personally responsible for any claims brought by any other Participant, should they refuse to accept the terms of this Agreement.
BY PURCHASING A TICKET FOR ANY BOSQUE RANCH LIVE EVENT, I ACKNOWLEDGE THAT I CAREFULLY READ THIS AGREEMENT ITS ENTIRETY, UNDERSTAND ITS CONTENTS AND ACCEPT IT, ON BEHALF OF MYSELF AND PARTICIPANT, AND I ACCEPT FULL RESPONSIBILITY FOR MY SAFETY AND THE SAFETY OF PARTICIPANT AND ASSUME AND UNDERSTAND ALL RISKS AND THAT I AM VOLUNTARY GIVING UP SUBSTANTIAL LEGAL
